AN ORDINANCE TO AMEND THE CODE OF THE BOROUGH OF SPOTSWOOD, CHAPTER 140 ENTITLED "NUISANCES" BY AMENDING SECTION 140-4, "AMENDMENTS" THEREOF AND ADDING A NEW SECTION 140-5 ENTITLED "VIOLATIONS AND PENALTIES"
PUBLIC HEARING - CLEARWATER VILLAGE MOBILE HOME PARK LICENSE RENEWAL- DECEMBER 18, 2006
Public hearing date was advertised in the Home News Tribune on November 20, 2006 and December 9, 2006 for the renewal of Clearwater Village Mobile Home Park License Renewal.

RESOLUTION
WHEREAS, Clearwater Village, Inc. has submitted an application for the renewal of its Mobile Home Park License in accordance with Section 78-11.11 of the revised General Ordinances of the Borough of Spotswood as adopted 1969 and amended and supplemented April, 1981; and
WHEREAS, the Borough Attorney, Gary M. Schwartz, Esq., the County Board of Health, the Borough of Spotswood Planning Board and the Building Inspector have reviewed the application with said Ordinance and have set forth no objection to its renewal; and
WHEREAS, there has been no change in ownership or interest in the property since the original license was issued, and there has been no change in the Mobile Home Park with respect to any matters set forth in the original license application of Clearwater Village, Inc. regarding matters submitted in support thereof; and
NOW, THEREFORE BE IT RESOLVED by the Borough Council of the Borough of Spotswood, County of Middlesex, and State of New Jersey, that Clearwater Village, Inc. is hereby awarded a renewal of it Mobile Home Park License for the lands described as Block 1.01, Lot 1; Block 2, Lot 1; and Block 3, as described on the Borough of Spotswood Tax Map.
BE IT FURTHER RESOLVED that the awarding of this renewal license (for the year 2007) is granted subject to the condition that Clearwater Village, Inc. will continue to comply with all Borough Ordinances now in existence as they may be amended or supplemented or deleted with the calendar year of 2006/2007.

2006-199 Tax Collector authorized to refund to Washington Mutual Bank $1,531.86 for property known as Block 94.1, Lot 14, overpayment the result of duplicate payment made by the mortgage company.
2006-200 Tax Collector authorized to refund to Wells Fargo Real Estate Tax Service, LLC $1,087.75for property known as Block 30, Lot 7.8, overpayment the result of payment made by closing attorney and Wells Fargo.

Tax Collector authorized to refund to Countrywide Tax Service for properties known as Block 104, Lot 2C1002, Block 85.3, Lot 3, Block 110.6, Lot 14, Block 31, Lot 3.5 and Block 31, Lot 3.4, for a total amount of $12,119.76 overpayment the result of duplicate payments.
2006-202 Tax Collector authorized to refund to LSI Real Estate Tax Service $1,663.55 for property known as Block 85.21, Lot 14, overpayment the result of duplicate payment.
2006-203 Tax Collector authorized to refund to Leona J. Fetyko, Administratrix of property known as Block 19, Lot 1 due to an error in assessment for 2006.
2006-204 Borough Council authorize the Tax Collector to grant total Disabled Veteran Exemption for property known as Block 94.3, Lot 18 on the Tax Map of the Borough of Spotswood as of September 17, 2006 and taxes were paid in full. A refund in the amount of $1,379.14 is overpaid from the time of exemption.
2006-205 Borough Council authorize Mayor and Borough Clerk to execute commitment to the PDM and FEMA Grant Mitigation Plan Application.
2006-206 CFO of the Borough of Spotswood is authorized to void outstanding checks over six months old.
2006-207 Appropriation transfers within the 2006 budget during the last two months of the year.

2006-191 Borough Council authorize the reduction of a performance bond posted by Gordon Park Estates as recommended by CME Associates for property known as Block 107, Lots 21.02, 23.03 and 24.
2006-192 Resolution authorizing the combination of several bond ordinances for various general improvements and water and sewer utility purposes and authorizing the combined sale and issuance of bond anticipation notes, in an aggregate amount not to exceed $950,000 of the Borough of Spotswood, in the County of Middlesex, New Jersey.
2006-193 Borough Council authorize the Business Administrator and Municipal Clerk to execute a contract with Xerox Corp. for the leasing of a new WCP238H Digital Copying System, as the 60 month lease is up with the 44 Digital System.
